Kuwait Approves New Digital Commerce Law to Accelerate Shift Toward a Modern Digital Economy

Kuwait has approved a new Digital Commerce Law, a major step toward modernizing the country’s business landscape and strengthening its role as a regional digital-economy hub. The Ministry of Commerce and Industry confirmed that the legislation, now awaiting ratification by His Highness the Amir, establishes a comprehensive legal framework for commercial activity in the digital space and closes long-standing regulatory gaps.

The law introduces clear definitions and streamlined processes for operating online, including a unified definition of the “digital merchant,” simplified licensing for e-commerce businesses, and full legal recognition of electronic documents, contracts, and digital signatures. It also enhances consumer protection through transparent dispute-resolution mechanisms and creates a Regulatory Sandbox to support innovation in emerging technologies.

Specialized Digital Dispute Resolution Committees will be established to ensure fast and fair handling of e-commerce conflicts.
Minister of Commerce and Industry Khalifa Al-Ajil said the law marks a pivotal moment in Kuwait’s digital transformation, enabling greater transparency, stronger consumer trust, and new opportunities for entrepreneurs and investors. The Ministry will now coordinate with public and private stakeholders to ensure a smooth transition into a fully integrated digital business environment.
