Nepal Releases Draft Electronic Commerce Directive 2082 to Regulate Online Shopping

The Ministry of Industry, Commerce, and Supplies has released the draft Electronic Commerce Directive, 2082, aimed at creating a fair, transparent, and consumer-friendly eCommerce environment in Nepal. Issued on January 6, 2026, the draft seeks to bring online shopping firmly within a legal framework under the provisions of the Electronic Commerce Act, 2081.

The proposed directive introduces mandatory registration for all eCommerce businesses on the official portal of the Department of Commerce, Supplies and Consumer Protection. It also requires platforms to use approved digital payment gateways and to issue electronic invoices for all transactions involving goods and services.

Consumer protection is a central focus of the draft. Online platforms will be required to encrypt customer data to prevent misuse, prohibit misleading advertisements, and avoid charging additional fees beyond product prices and shipping costs. In cases of payment failure, businesses must refund customers within seven days.

The directive also outlines strict compliance and monitoring measures. Unregistered eCommerce platforms that fail to register within seven days of notice may face termination. The department plans to deploy inspection officers for regular oversight and mandates that platforms establish online grievance-handling systems. If disputes cannot be resolved directly, cases will be referred to the E-Commerce Dispute Resolution Committee for mediation.

Existing eCommerce platforms will be given a 35-day window to register once the directive comes into force. The ministry has invited stakeholders to submit feedback and suggestions on the draft within seven days.
